Criminal proceedings are launched not only against habitual offenders. The rules of conduct of today’s society, reinforced with criminal law are so complicated and expansive that some of its prohibitions may be violated by any average person. Such a person may not necessarily know that in Hungary it is a crime to drive a car three quarters of an hour after drinking three or four pints of wine, to employ a 17 year-old for ten hours a day in the bar of a festival, or to enter without authorisation an area not open to spectators of a sports event.
Since the introduction of „zero tolerance”, the laws prescribe even harsher punishments for drunk driving (drink driving, DUI) than before. Beside a fine running to several hundred thousand Forints, your driver’s licence may be suspended for a couple of years, you may be obliged to take a drunk driving (drink driving, DUI) rehabilitation course, but in an extreme case you may even receive a suspended or an executable prison term.
As per our Criminal Code in force, the criminal act of assisting illegal entry (smuggling illegal aliens) (§353) is committed by someone who aids another person in crossing a state border illegally. Due to the egregious nature of this crime, even the standard form of it is punishable by a prison term not exceeding three years. Albeit assisting illegal entry (people smuggling) is a crime of the type of aiding, the legislator lists it as an autonomous criminal act under the offences against public administration.
